Welcome to Outfit Swap Studio ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website and services (collectively, the "Service") located at outfitswapstudio.com.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Description

Outfit Swap Studio is an AI-powered virtual try-on and clothes changing platform. Our Service allows you to:

  • Upload your photos and swap outfits using AI technology
  • Choose from preset outfit styles for professional and casual looks
  • Generate AI-powered outfit transformations
  • Download and use generated images for personal or commercial purposes (based on your plan)

3. Eligibility

To use our Service, you must:

  • Be at least 18 years old or the age of legal consent in your jurisdiction
  • Be legally capable of forming binding contracts
  • Not be prohibited from using the Service under applicable laws

Minors may use the Service only with parental or guardian consent and supervision.

4. User Accounts

To access certain features of our Service, you must create an account. When creating an account, you must:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Promptly update your account information to keep it accurate
  • Accept all risks of unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

5. Credits System

Our Service operates on a credits-based payment system:

  • Cost: Each AI outfit swap costs 5 credits
  • Credit Packs: One-time purchases ranging from $4.99 (40 credits) to $19.99 (250 credits)
  • Subscriptions: Monthly plans from $12.99/month (Creator - 200 credits) to $24.99/month (Pro - 600 credits)
  • Expiration: One-time credit packs do not expire; subscription credits do not roll over
  • Non-transferable: Credits cannot be transferred between accounts
  • New Users: Free accounts receive 25 credits upon registration

6. Payment Processing

All payments are processed by Creem (creem.io) as the Merchant of Record:

  • Creem handles payment processing, tax collection, and compliance
  • By making a purchase, you agree to Creem's Buyer Terms of Service
  • Subscription plans auto-renew unless cancelled before the billing date
  • You can cancel your subscription at any time from your account dashboard
  • Cancellation stops future charges; access continues until the end of the current billing period

7. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe upon the rights of others
  • Upload or generate pornographic, sexually explicit, or NSFW content
  • Create content depicting violence, gore, or terrorism
  • Upload photos of minors or generate content involving minors
  • Upload photos of other people without their consent
  • Create deepfakes or content intended to deceive, defraud, or misrepresent identity
  • Generate content that infringes intellectual property, portrait rights, or publicity rights
  • Upload or transmit viruses or malicious code
  • Engage in any activity that disrupts or interferes with the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Attempt to reverse-engineer or extract the AI models
  • Harass, abuse, or harm another person
  • Use the Service for any illegal or unauthorized purpose

8. User Content & AI-Generated Content

Your Uploaded Content

You retain ownership of photos and content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of operating and providing the Service.

AI-Generated Content

  • You receive a non-exclusive license to use AI-generated images for personal use (free tier) or personal and commercial use (paid plans)
  • We do not claim ownership of AI-generated images created from your photos
  • You are responsible for ensuring you have necessary rights and permissions for commercial use
  • AI-generated content may vary in quality; we do not guarantee specific results

No Model Training

We do not use your content or outputs to train our or third parties' AI models without your explicit consent.

9. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Outfit Swap Studio and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Refund Policy

Our refund policy includes:

  • 7-Day Money-Back Guarantee: First-time purchases are refundable within 7 days if less than 20% of credits have been used
  • 48-Hour Renewal Refund: If you forgot to cancel, request a refund within 48 hours of renewal charge (if no new credits used)
  • Credit Packs: Refundable within 7 days if less than 20% of credits used
  • No Refund: For used credits, Terms violations, or requests after the eligible timeframe

11. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OUTFIT SWAP STUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amounts paid by you to us in the preceding 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Outfit Swap Studio and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.

14. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in the State of Delaware.
